FREQUENTLY ASKED QUESTIONS

BUILDING PERMITS

When do I need to get a building permit?  A permit is required when any type of structural work is done on your home.  A building permit is needed for any remodels, additions, roofs, siding, and structural changes including a deck or porch raised off the ground, garages, accessory buildings over 200 sq. ft., changing existing windows, adding or changing existing walls, or finishing interior attic or basement space.  A site plan may also be applicable.  
What will I need to get a building permit? You will need detailed drawings of the proposed construction.  The drawing should include a site plan, foundation plan, floor plans, elevations and wall section showing basic materials and methods of construction.  Also:
  • A Building Permit Application 
  • A Soil Erosion Permit may be required from the Bay County Drain Commission (989) 895-4290.  All new residential construction requires a Soil Erosion Permit.  
  • Other permits may be required by the Health Department, MDOT, EGLE, or other applicable agencies.
  • For commercial projects, an architect or engineer is required to prepare the drawings for other than minor work, as determined by the Building Inspector.
  • For commercial projects, review of the site plan by the Planning Commission may be required
  • A permit fee
How much is a building permit?  The cost of a building permit is based on the estimated cost of construction.
When is a demolition permit required?  A permit is required for any building being completely demolished. This includes the home, garage, or any other out building located on the property.
What about swimming pools? 
  • Above-ground swimming pool code rules:
    • Pools above ground over 24" in height require a building permit
    • Pools above grade to have at least a 48" barrier around the perimeter of the pool
    • If a railing is required around the pool, spindles must be placed so that a 4" sphere cannot pass through them
    • A fence or railing access shall have a gate which is self-closing, lockable, and swings out
    • Any ladder or steps shall be capable of being secured and locked or removed to prevent access
    • Pools cannot be located any closer than 10' from a side property line or 20' from a rear property line
    • Pools cannot be located under an electrical wire or in a front yard
    • Any electrical plug within 25' of a pool must be grounded
    • If there is a direct access door from the home to the pool such as a sliding door, it shall have an alarm when the door opens.  The alarm shall sound for 30 seconds and be capable of being heard throughout the house.  The house can have a switch to deactivate the alarm after 15 seconds.
  • In-ground swimming pools are by permit; fees are based on the estimated cost of construction

PLANNING/ZONING

  • To be able to do to something that is not residential on a residential property, such as having a business from home, requires a Special Use permit
  • To change a property from one classification to another (i.e. Residential to General Business), requires a petition for Zoning Change
  • As new businesses move into the Township, a Site Plan Review application is needed to review the business proposal
